1. These general terms and conditions, read together with the Privacy Policy constitutes a legal and binding contract between you and JBP Commercial Brokers ("INDAAZ"), a limited liability company validly existing under the laws of UAE (hereinafter referred to as "T&Cs"). The T&Cs contain the terms and conditions that are applicable to all the services that INDAAZ offers to you or to any of its customers across any or all of its platforms("INDAAZ Services") . The T&Cs may be changed or amended by INDAAZ from time to time with or without prior notice and updated on the INDAAZ website INDAAZ.com ("INDAAZ Website").
2. You are required to read and familiarize yourself with these T&Cs and your continued use of any of INDAAZ Services or the use of INDAAZ Platforms (as hereinafter defined) or any or all of the functionalities of INDAAZ Platforms is an automatic confirmation of the fact that you have read, understood and accepted all the terms and conditions laid down in the T&Cs as well as the updated terms and conditions on the INDAAZ Website.
3.INDAAZ Services are provided to you by INDAAZ in its role only as an intermediary and a service provider. INDAAZ Services may include but not be limited to indirect selling and distribution of products and services of the INDAAZ Partner Institutions (hereinafter defined). INDAAZ is not a financial institution and is not governed by the Central Bank of the UAE. As such, INDAAZ does not have and is not authorized to have or sell financial products of its own.
4 The "INDAAZ Partner Institutions": INDAAZ Partner Institutions are entities that INDAAZ has sales or distribution arrangements and agreements with. Pursuant to the agreements with INDAAZ Partner Institutions, INDAAZ is authorized to make available and sell to you specific products and services provided by the INDAAZ Partner Institutions. The INDAAZ Partner Institutions include but may not be limited to banks, financial Institutions and finance companies registered in the UAE or in any other country or geography. INDAAZ Partner Institutions may include any entity that provides any products or services with whom INDAAZ has an agreement to sell or distribute the products or services provided by that entity. The list or set of INDAAZ Partner Institutions may increase or decrease from time to time as INDAAZ execute new agreements with additional entities or terminates an existing agreement with an entity.
5 "INDAAZ Platforms": INDAAZ Platforms include any mode of interaction that you use to interface with INDAAZ and vice versa or INDAAZ uses to interface and interact with the INDAAZ Partner Institutions and vice versa. INDAAZ Platforms may include but not be limited to mobile applications "INDAAZ App", INDAAZ Website, interface over the phone, SMS, physical interface through in person meetings by INDAAZ representatives, mail, e-mail and social media platforms including Whatsapp.
1 When you opt to use INDAAZ Services to apply for a product or service of a INDAAZ Partner Institution, you will be asked to and be required to provide a certain set of your data as defined in the Privacy Policy including but not limited to information and documents, including your financial information, identification documents like Emirates ID and passport and any other national ID, (collectively "Customer Data") to INDAAZ about yourself through any of INDAAZ Platforms. The Customer Data provided by you to INDAAZ may be used to register you as a INDAAZ customer and create a INDAAZ customer account for you ("INDAAZ ID"). You expressly authorize INDAAZ to store the Customer Data that you provide to INDAAZ through any INDAAZ Platform and for INDAAZ use it in accordance with the terms and conditions laid out in the T&Cs read together with the Privacy Policy that is available on the INDAAZ Website. Customer Data that you will be required to provide in order to use INDAAZ Services to apply for products of INDAAZ Partner Institutions may include Customer Data asked for by any or all of INDAAZ Partner Institutions in the format of the respective INDAAZ Partner Institution. INDAAZ reserves the right to reject your registration as a INDAAZ customer or to let you proceed with use of INDAAZ Services for any reason whatsoever.
2 INDAAZ may pass on Customer Data to any of the INDAAZ Partner Institutions of its choice including but not limited to the INDAAZ Partner Institution that you have indicated as your choice for applying for a product through any of the INDAAZ Platforms. INDAAZ Partner Institutions may then use Customer Data to assess and evaluate your application and carry out investigations as they deem appropriate to approve or decline your application. The final decision on the approval of any financial product or credit facilities including approval and issuance of credit cards, as well as the subsequent sanction of any Credit card limit or approval of any loan and as well as the extent of the loan amount approved will all be done at the sole discretion of the respective INDAAZ Partner Institutions to which Customer Data have been sent and the application has been made, and is subject to that INDAAZ Partner Institution's policy and guidelines. Please note that INDAAZ provides no assurance of approval in this regard and is merely an intermediary and a service provider enabling and assisting you (the customer /applicant) in the associated application process. Any loan amounts or credit card limits or any other preliminary approval amounts indicated through any of INDAAZ Platforms will only be purely illustrative in nature and not an assured amount. In this process of assessment, INDAAZ Partner Institutions may ask you for additional data as well as documents from you directly or through INDAAZ.
3 You hereby agree and acknowledge that while using INDAAZ Services and INDAAZ Platforms, INDAAZ may carry out its own verification of Customer Data. These verifications may include but not be limited to mobile number verification by way of one-time password (OTP) being sent to the mobile number you provide to INDAAZ. INDAAZ Platforms may also ask you to provide your photograph either by way of a file upload or directly by the use of camera features built in any of the INDAAZ Platforms. These photos may be used to match with the photos on your documents including your Emirates ID. While using INDAAZ Services through any INDAAZ Platform, you may also be required to capture a video of yourself for video consent and as proof of your using INDAAZ Platforms. INDAAZ Platforms may also have other security features like geographic location identification.
4 INDAAZ Services are provided by INDAAZ only as an intermediary between you the customer/applicant and INDAAZ Partner Institutions. As a part of your using INDAAZ Services to apply for the products of INDAAZ Partner Institutions, INDAAZ Partner Institutions may also ask you to fill their own application forms for the products you apply for and those application forms may carry their own set of terms and conditions that the INDAAZ Partner Institutions will and do want you to read, understand and accept as a part of the application process. By using INDAAZ Services through any INDAAZ Platform, you understand and acknowledge that during the application process and further whether the INDAAZ Partner Institution approves or declines your application, nothing will ever constitute a tripartite agreement between you, INDAAZ and any INDAAZ Partner Institution during the application process or thereafter. You acknowledge that INDAAZ will not be liable, to the extent permitted under applicable laws, for any claims arising out of any dispute between you and INDAAZ Partner Institutions.
5 You acknowledge that while acting as an intermediary between you and the INDAAZ Partner Institutions, INDAAZ will make every attempt on a best effort basis to make sure that the description of the products and services of the INDAAZ Partner Institutions is accurate at a point in time, the INDAAZ Partner Institutions may change the description and features of the products and services they provide from time to time and you acknowledge that you will independently keep yourself updated of these descriptions and features and their suitability to your needs including any changes therein for a product or service of any INDAAZ Partner Institution.
6 By using INDAAZ Services through any INDAAZ Platform you certify that the Customer Data you provide including any documents like Emirates ID copy, Passport copy, income and employment documents and proof, bank statements etc., are true and correct and that you shall be obligated to inform INDAAZ in writing of any changes thereto. You also expressly authorize INDAAZ at its discretion to collect, use and store your Customer Data and any information that INDAAZ may get from INDAAZ Partner Institutions or from institutions like credit bureaus and banks including international credit bureaus and banks in any geography for whatever purposes it may require including sending it to INDAAZ Partner Institutions for the purposes laid down in this T&Cs and also for data processing, marketing and selling products of INDAAZ Partner Institutions to you, and for statistical and risk analysis purposes or to comply with the applicable laws, rules and regulations. By use of INDAAZ Services you also irrevocably and unconditionally authorize INDAAZ to make inquiries with, obtain your information from or supply your information to any bank or financial institution including INDAAZ Partner Institutions or credit bureau or credit reporting agency in any jurisdiction for any purpose relating to but not limited to your financial position, employment, income or credit history.
7 By use of INDAAZ Services you also authorize INDAAZ to use your Customer Data you provide to INDAAZ including names and contact details of any references you provide to contact you or the references by any means for verification as well as to send you promotional or marketing materials through any INDAAZ Platform or over e-mail, SMS, social media, phone, or any other means of communication. You also authorize INDAAZ to contact you by any means of communication including INDAAZ Platforms, INDAAZ employees, representatives and agents, unless specifically informed to us in writing by you or the references to not do so.
8 You acknowledge and certify that while using INDAAZ Services, you have satisfied yourself entirely that you are competent to use INDAAZ Services to apply for products of INDAAZ Partner Institutions with respect to all UAE laws as well as laws of any other jurisdiction that you may be subjected to. You also hereby acknowledge and certify that you understand that INDAAZ will not be responsible, to the extent permissible under applicable laws, in any way for any claims by anyone against you arising out of your use of INDAAZ Services as well as any INDAAZ Platform. You certify that you will use INDAAZ Services and INDAAZ Platforms in accordance with all applicable laws.
9 You acknowledge and certify that you will use INDAAZ Services and INDAAZ Platforms securely and that all verification processes on INDAAZ Platforms like mobile number and OTP verification, Emirates ID photo match, video KYC etc. will be done by you to prevent impersonation by someone else on your behalf. You also certify and acknowledge that you understand that there is a certain amount of risk associated with transmitting or providing your data by the use of INDAAZ Platforms and that by continuing to use INDAAZ Services or INDAAZ Platforms, you accept that risk and agree to keep INDAAZ and INDAAZ Partner Institutions indemnified against any loss incurred by you or them in this regard. You also agree to keep INDAAZ and INDAAZ Partner Institutions indemnified against any malfunction of INDAAZ Platforms including but not limited to conditions of Force Majeure.
10You acknowledge that these T&Cs will remain in force at all times during your use of INDAAZ Services and INDAAZ Platforms as well as after you have stopped using them.
11 Termination: You acknowledge that your use of INDAAZ Services or INDAAZ Platforms may be terminated by INDAAZ in the event of breach of any terms and conditions laid down in these T&Cs . Your use of INDAAZ Services and INDAAZ Platforms may also be terminated by INDAAZ at its sole discretion without providing any reasons whatsoever.
12 You acknowledge these T&Cs may not be terminated or amended without prior written consent by INDAAZ. These T&Cs will hold for all INDAAZ Services and INDAAZ Platforms including any future INDAAZ Services and INDAAZ Platforms.
13 You acknowledge and understand that any communication between you and INDAAZ or its employees, representatives or agents, through any INDAAZ Platform including over the phone may be recorded. Such recording and monitoring shall be for training, quality assurance, complaint handing and other internal investigation purposes in accordance with applicable laws. At any time, including upon your stopping use of INDAAZ Services, such recording may be disclosed to INDAAZ Partner Institutions and also used as evidence in legal proceedings.
14 Fees and charges: From time to time, INDAAZ may apply fees and charges to be paid by you to INDAAZ. These fees and charges will be informed to you by way of information available on the INDAAZ Platform that you use. These fees and charges will be of a non-refundable nature and INDAAZ reserves the right to recover / retain any fees that may have been earned.
15 You warrant that you will use INDAAZ Platforms only to use INDAAZ Services and for your own personal use. You also warrant that you will not make any attempt to disrupt any of INDAAZ Platforms especially the INDAAZ App or the INDAAZ Website by way of any virus or malware or hacking or other technology or in any other manner.
16 Force Majeure: INDAAZ will not be responsible or liable to you for any delay or failure in performing its obligations under these T&Cs if such performance is hindered due to events beyond the reasonable control of INDAAZ and occurring without its fault or negligence, including, due to war, acts of terrorism, sabotage or piracy; plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions; act of authority whether lawful or unlawful, compliance with any law or governmental order, rule, regulation or direction, curfew restriction, expropriation, compulsory acquisition, seizure of works, requisition, nationalization; act of God or natural disaster, destruction of office machines, equipment, disruption of processing facilities and of any kind of installation, telecommunication or electric current or disruptions or breach in power, telecommunication and internet systems; acts of third parties including but not limited to INDAAZ Partner Institutions.
17 Governing Law and Dispute Resolution: These T&Cs will be subject to and be governed by the laws of the United Arab Emirates. Any dispute or legal proceedings in connection with the T&Cs will be subject to the exclusive jurisdiction civil courts of Dubai.
1. In relation to your use of INDAAZ Platforms or INDAAZ Services, you hereby irrevocably and unconditionally consent to permits and authorizes INDAAZ to:
a Share or provide your information that you have provided to INDAAZ through the use of any of INDAAZ Platforms or INDAAZ Services, to any Credit Bureau(s) based in any geography, country or jurisdiction including but not limited to Al Etihad Credit Bureau Company (all such entities collectively referred to as “Credit Bureaus” for the purposes of this agreement). Such information may include but not be limited to personal information, financial or credit information.
b Obtain or access any of your information including but not limited to personal information, financial information or credit performance information from or by the use of any Credit Bureau’s services or database.
c Use your information so obtained to carry out activities including but not limited to data analytics, providing your information so obtained to share with INDAAZ Partner Institutions, to assess your suitability or approval or rejection for a financial product through any of INDAAZ Partner Institutions, sharing your information so obtained from any Credit Bureaus with INDAAZ employees, affiliates, agents, any third parties that INDAAZ has appropriate arrangements with wherever situated, or for any other activity relating to your application for a financial product through INDAAZ or the use of any of INDAAZ Platforms or INDAAZ Services.
2 You understand and acknowledge that the Credit Bureau Consent shall remain in force at all times unless a request to withdraw such consent is submitted by you in writing with INDAAZ.
3 You understand and acknowledge that your information provided by INDAAZ to Credit Bureaus may be used by such Credit Bureaus for storage as well as any data analysis and may also be shared by such Credit Bureaus further with banks, financial or other institutions or affiliates of that Credit Bureaus.
4 You understand and acknowledge that INDAAZ will provide your information to any Credit Bureaus without any liability on the part of INDAAZ or liability, to the extent permitted under applicable laws, on the part of INDAAZ or INDAAZ Partner Institutions or Directors or Employees or Agents or affiliates of INDAAZ.
5 You understand and acknowledge that INDAAZ or any of its directors or employees or INDAAZ Partner Institutions or INDAAZ affiliates will not be liable or responsible for any loss or damage incurred by you because of the receipt of any incorrect or incomplete information about you from any Credit Bureaus.
The customer expressly acknowledges and accepts the following terms and conditions relating to the INDAAZ Wallet and the INDAAZ Cash Back Points:
1 The "INDAAZ Wallet" or "Wallet" is an integral feature only for all registered customers on INDAAZ's Platforms. It functions as a virtual repository, exclusively designed to earn, store and accumulate INDAAZ Cashback Points ("JCP") for INDAAZ customers as a part of their profile with INDAAZ, the INDAAZ Wallet and JCP may be made available to customer from time to time at the sole discretion of INDAAZ.
2 The Wallet is geared towards enhancing user experience, serving as a platform to manage the JCP earned by INDAAZ Customers. It is essential to note that the Wallet is not akin to digital cards or wallets for direct purchases outside of the INDAAZ Platforms or apart from the way INDAAZ at its sole discretion authorizes the use of the Wallet.
3 JCP are rewards given in the form of points by INDAAZ to customers, prospects and applicants of INDAAZ for successful accomplishment of certain tasks and stipulated conditions being met by the customer which may include but not be limited to applying for a financial product, referring a customer to INDAAZ, providing or completing personal and financial information etc. Grant of any JCP to any customer is entirely at the sole discretion of INDAAZ and can be done only if INDAAZ is satisfied that the conditions laid down by INDAAZ for the earning of JCP are met successfully by the customer. To serve as an example and highlight the subject matter of this clause: In case JCP are granted to the customer for applying for a product or multiple products through INDAAZ, JCP will be due only upon successful acceptance of the customers application by a INDAAZ Partner Institution. Again, as another example: In case JCP are granted to the customer for referring another customer to INDAAZ, JCP will be due on upon the successful acceptance of the referred person’s application by the INDAAZ Partner Institution to which such application was sent.
4 JCP is not akin to actual monetary value in any form or denomination. From time-to-time INDAAZ may decide to convert JCP to any monetary value and credit a INDAAZ customer’s bank account registered with INDAAZ. Such conversion will only be under conditions stipulated by INDAAZ at its sole discretion. This conversion ratio of JCP into monetary value will be done at a ratio decided at the sole discretion of INDAAZ and such ratio may be changed by INDAAZ at its sole discretion from time to time with or without intimation to INDAAZ Customers.
5 Expiry of JCP: JCP may have an expiry date, post which they will expire. Duration to expiry of JCP will be decided by INDAAZ at its sole discretion and may change from time to time. Expired JCP cannot ordinarily be reinstated. Any reinstatement of expired JCP can be done only at the sole discretion of INDAAZ.
6 JCP are non-transferable, non-exchangeable, and non-convertible to any tangible monetary value of any nature by the customer unless decided so by INDAAZ at it's sole discretion.
7 It is incumbent upon customers to ensure the bank details they decide to register with INDAAZ are accurate and current. INDAAZ will not be responsible in any way for any damage or liabilities arising from discrepancies due to inaccurate bank account information provided by the customer to INDAAZ. Customers might be subjected to transaction fees during JCP conversion to monetary value via credit to their bank account and any such transaction fees will entirely be borne by the customer.
8 Tax implications: INDAAZ customers must be cognizant of any actual, potential, current or future tax implications that they may be subject to because of earning JCP or their conversion to monetary value in the customer’s hands and any such tax liability or implication will be the sole responsibility of the customer and INDAAZ will not be liable to any such tax liability or implication. In case of any doubts regarding this, INDAAZ recommends customers to consult with competent tax authorities or professionals for guidance on this subject and satisfy themselves.
9 JCP and the INDAAZ Wallet programs may be stopped or dissolved at any time at the sole discretion of INDAAZ. JCP once credited to the customer’s INDAAZ Wallet may be withdrawn by INDAAZ at the sole discretion of INDAAZ and this may be done at any point of time including after JCP has been granted to the customer if INDAAZ believes that the conditions required to be completed by the customer were not fulfilled prior to the granting of such JCP.
The decision whether the customer has met the conditions required for the grant of any JCP is entirely at the sole discretion of INDAAZ. Any conversion of any JCP any monetary value or any other items of any value will be entirely at the sole discretion of INDAAZ.
